Work Permit

A work permit visa is a legal document that allows a foreign national to work in a specific country for a set period. To obtain a work permit visa, you usually need a job offer from an employer in that country. The employer must demonstrate that they could not find a suitable candidate locally.

Canada’s work visa program aims to attract skilled professionals from around the world to enrich its vibrant economy and diverse job market. Individuals can obtain work permits primarily through the Temporary Foreign Worker Program (TFWP) and the International Mobility Program (IMP). Employers must obtain a Labour Market Impact Assessment (LMIA) under the TFWP to show that hiring a foreign worker will not adversely affect the Canadian job market. In contrast, the IMP permits work without an LMIA, typically based on international agreements or significant benefits to Canada.

Different Types of Work Permit in Canada ​​

An open work permit is granted to  foreign nationals. It allowing employment in Canada with any employer and at any location. However, a restricted open work permit is imposed with certain limitations, such as restrictions on the industry or occupation, yet it still permits work across various locations within Canada. All open work permits are exempted from the requirement of a Labour Market Impact Assessment (LMIA).

International students who have graduated from a designated learning institution (DLI) can apply for a Post-Graduate Work Permit (PGWP). This permit allows students to gain Canadian work experience after completing their study program. The validity of a post-graduate work permit extends up to 3 years, with the duration determined by the length of the study program completed.

If you belong to one of the following categories, you can apply directly for a work permit and may be exempt from applying for an LMIA:

– Participants in International Experience Canada programs (working holiday, young professionals, co-op students)
– Intra-company transferees
– CSQ holders in Quebec who already hold a work permit
– Spouses and common-law partners of full-time students
– Spouses and common-law partners of workers employed in NOC categories 0, A, or B
– Entrepreneurs
– Francophone mobility workers (skilled work outside of Québec)
– International Mobility Program participants
– Applicants for Bridging Open Work Permits who have already applied for permanent residence

Federal skill traders program for skilled trained person like mechanic or electrician can work in Canada under FSTP. Application submitted through the express entry system may be proceed within 6 month under federal skill trader program.

If you have already applied for permanent residency under the Federal Skilled Worker Program, Federal Skilled Trades Program, Canadian Experience Class Program, Provincial Nominee Program, Agri-Food Pilot, Home Child-Care Provider Pilot, or Home Support Worker Pilot Programs, you may be eligible to apply for a Bridging Open Work Permit (BOWP).

This open work permit allows you to continue working while your permanent residency application is being processed.

An international business can bring an executive, senior manager, or employee with specialized knowledge to Canada on a temporary work permit if it has a parent, subsidiary, branch, or affiliate of that enterprise in Canada.

Spouses or partners of Canadian citizens or permanent residents can apply for unrestricted work permits while their application outcome is still pending. To be eligible, you must hold a valid temporary residence permit and have an application for permanent residency in progress.

3. Show proof that you have the necessary skills and qualifications for the job.
4. Demonstrate that you will leave Canada once your work permit expires, if applicable.
5. Meet health and security requirements, including a medical exam and police clearance if necessary.

Eligibility requirements for work permit for Canada​​

To convince the assessing officer that you will leave Canada once your work permit expires.

1. Provide sufficient proof of funds to support yourself and your family members (inside or outside Canada) during your stay and to return home.
2. Prove that you are admissible to Canada and have no record of criminal activity.
3. Demonstrate that you will not pose a danger to Canada’s security.
4. Show that you are in good health and, if needed, undergo a medical exam.
5. Ensure you do not plan to work for an employer listed as “ineligible” on the list of employers who failed to comply with conditions, or participate in unauthorized work.
6. Confirm that you do not plan to work for an employer who regularly offers striptease, erotic dance, escort services, or erotic massages.
7. Provide all necessary documents requested by the officer to prove your eligibility to enter the country.
