A conjugal partnership is a relationship between two individuals who share a marriage-like bond without being legally married and are unable to live together due to circumstances beyond their control. To qualify for conjugal partner sponsorship, the relationship must have existed for at least one year before application. This category applies to those who do not meet the spousal sponsorship criteria or the definition of a common-law partnership. While a conjugal partner may have a sexual or physical relationship, other factors also define their bond. Eligibility requires that the inability to cohabit stems from circumstances beyond both partners’ control. The IRCC considers conjugal partnerships exceptional; thus, couples who could qualify as a common-law union do not meet this category. A conjugal partner must reside outside Canada and have been in a relationship for at least one year, unable to live together due to reasons like immigration, sexual orientation, or religious beliefs.
The sponsor must be at least 18 years old.
The sponsor must be a Canadian citizen, permanent resident, or a person registered in Canada as an Indian under the Canadian Indian Act.
Permanent residents residing outside Canada cannot act as sponsors.
For sponsorship of a spouse, common-law, or conjugal partner, the sponsor is financially responsible for the sponsored person(s) for at least 3 years after they become permanent residents, which includes repaying any social assistance received by the sponsored individual(s).
Generally, there is no income requirement to sponsor a spouse or conjugal partner unless the sponsored individual has a dependent child with children of their own.
The sponsor must prove they are not receiving social assistance for reasons other than a disability and must be able to provide for the basic needs of the sponsored person(s).
The person being sponsored, along with their family members, must pass background, security, and medical checks.
